Terms of Service

These Terms of Service ("Terms") govern your access to and use of the ThirdText platform ("ThirdText", "the Service"), operated by Thirdsan Enterprises Ltd ("Thirdsan", "we", "us"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility & Accounts

You must be at least 18 years old and able to form a binding contract to use ThirdText. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

2. The Service

ThirdText provides a platform for sending bulk and transactional SMS messages, managing contacts and campaigns, and tracking delivery. We may add, change, or remove features at any time, with reasonable notice for material changes.

3. Acceptable Use

You agree not to use ThirdText to send messages that:

  • Are unsolicited, deceptive, or violate applicable anti-spam laws;
  • Contain fraudulent, threatening, defamatory, or illegal content;
  • Impersonate any person or organization, or use an unauthorized Sender ID;
  • Promote illegal gambling, pyramid schemes, or unlicensed financial products.

We reserve the right to suspend or terminate accounts that violate this policy, without refund of unused credits.

4. SMS Credits & Billing

Access to messaging is billed via prepaid SMS credits or wallet balance. Credits are deducted per message segment sent and are non-refundable except where required by law or expressly stated otherwise. Prices are subject to change with notice.

5. Sender IDs

Custom alphanumeric Sender IDs are subject to review and approval. We may reject or revoke a Sender ID that is misleading, infringing, or used to violate these Terms.

6. Data & Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect personal data, including recipient phone numbers you upload.

7. Service Availability

We aim for high uptime and delivery reliability but do not guarantee uninterrupted service, as message delivery depends in part on third-party telecom networks outside our control. Current platform status is available at status.thirdtext.digital.

8. Limitation of Liability

To the maximum extent permitted by law, Thirdsan Enterprises Ltd shall not be liable for indirect, incidental, or consequential damages arising from your use of the Service, including losses resulting from delayed or failed message delivery.

9. Termination

You may close your account at any time. We may suspend or terminate access for breach of these Terms, non-payment, or suspected fraudulent or abusive activity.

10. Governing Law

These Terms are governed by the laws of the Republic of Uganda. Any disputes shall be subject to the exclusive jurisdiction of the courts of Uganda.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
